Hooning offences are classified into two broad types. Each type carries its own immobilisation, impound and confiscation penalties. Irrespective of the type, You may be issued with an infringement notice, an order to appear in magistrate court or even be arrested if the issue is more serious.
TYPE 1 HOONING
Dangerous driving, taking part in speed trials and racing by any means including promoting and organising the activity, careless driving, making unnecessary smoke and noise while using roads and of course evading police falls under type 1 hooning.
Your vehicle can be immobilised for 90 days as a penalty. For subsequent type 1, Police can impound your vehicle until completion of all procedures for all charges on you. In some cases, The vehicle might be taken over by the state.
TYPE 2 HOONING
Driving without proper documents(unlicensed, suspended licence, unregistered or uninsured vehicle), drunk and driving (high range — 0.15% blood alcohol level), driving while under a 24-hr suspension order, crossing speed limit by more than 40km/h and driving a modified vehicle that does not fulfil safety standards easily makes you a type 2 hooning offender.
The penalties vary from impounding the vehicle for 7 days to 90 days depending on the reason. It might even end up in confiscation of your vehicle if evidence goes against you, says the expert.
