Internet Registry Pty Ltd (trading as NetRegister) consents to Federal Court Orders

Announcement posted by auDA 27 Sep 2002

Internet Registry Pty Ltd and its Director Paul Chesley Rafferty today gave undertakings to the Federal Court in the form of the interlocutory injunctions sought by auDA.

These undertakings cover matters arising from the NetRegister mail out (sent to domain name registrants two weeks ago) and include the preservation of all records until the determination of the final proceedings.

As is standard practice, the Court has also made certain directions orders including that, prior to a full hearing, the matter be referred to mediation. Unless the mediation or other negotiations are successful auDA will be seeking, as final relief:

declarations that the 'Net Register' mail out is misleading or deceptive in certain respects;

declarations that Internet Registry has engaged in conduct which is misleading
or deceptive in breach of the Trade Practices Act and, in breach of the Act,
has falsely represented the need for services;

declarations that Paul Chesley Rafferty was knowingly concerned in the breaches of
the Trade Practices Act by Internet Registry; and

an order directing Internet Registry to send a corrective mail out and
file an Affidavit confirming that it has done so.

The next step in the proceedings is a directions hearing set down for 8 November 2002.

Internet Registry Pty Ltd and NetRegister have no connection whatsoever with auDA accredited registrar NetRegistry Pty Ltd.
