High profile Barrister Charles Waterstreet’s clients Warwick & Terry Howarth will host a news conference in Parliament House Canberra In Private Dining Room 1 at 12.30pm Monday 22nd October . The Howarths of Howarth Drilling have lost their livelihood due to actions and inactions by both the Federal and NSW Governments relating to NSW introducing mining legislation which goes against existing International Trade Treaties in place with the Federal Government.

BACKGROUND INFORMATION

On 31 January 2014 the NSW government, introduced an Amendment Bill through the Mining legislation, which allowed the government to seize property without compensation, and to disregard the rights of local investors, all who are in search of improving their livelihood, and to provide for their families and retirement, which is now uncertain. Mr Warwick Howarth and his wife Mrs Terry Howarth of Howarth Drilling, grandparents of seven, lost their savings, livelihood, and continue to suffer emotional and mental anguish when the NSW Liberal government failed to compensate. Though it clearly states within the Australian Constitution that such actions (seizing of property) by the government is to be supported by compensation.

The Howarths and investors have faced a real struggle over the past four year in their plight to seek justice, and the restoration of the rights of all citizens within the Australian Constitution.

Despite communicating with the government on numerous occasions for the past four years there has been no proactive actions undertaken by the government to correct and restore the rights of both national and international investors, and family businesses who have lost monies and their investments due to the conduct of the current NSW government.

Further, the Amendment Bill breached the terms of international trade treaties between the United States and Japan, when the NSW government seized property without compensation to international investors.

The Federal government as a direct result of the State governments actions have now failed to protect the rights of its citizens, and failed to observe and uphold its international obligations within the trade treaties by the NSW government’s introduction of the Amendment Bill. As such, the current NSW government has created uncertainty for national and international investors/investments within Australia.

The Federal government, who is a signatory to the Trade Treaties have now failed to observe and breached the human rights of its citizens, which are enforced within the Australian Constitution. This conduct by the Federal and State NSW governments is Un-Constitutional and Un-Australian.
